The Bush administration used OFAC to act against Richard Chichakli outside the framework of the American legal system. OFAC is an entity that is attached to the Treasury Department, but work directly at the orders of the US president. OFAC was designed as a political tool to issue sanctions against the foreign enemies of the United States where legal remedies are not available, and later was used to issue sanctions against countries and organization that oppose the politics of the US.  The sanctions and orders of OFAC has no value whatsoever outside the US; however, they are much feared within the US.

Richard Chichakli was denied all of his constitutional and legal rights under OFAC action. The question of the constitutionality of the government act is not yet tested, and such test must be done at the US Supreme Court. 

Without any legal basis, charges, indictment, trial or even presenting evidence OFAC terminate and closed down Richards' accounting practice and other business, and confiscate his money , home, car, and personal effects, OFAC also took away all of Richard's basic constitutional rights including the rights to:

• Took away Richards' right to work and/or gain employment

• Own property, real or personal

• Buy, sell, or trade (including buying food, medical supplies, etc.)

• Engage in any business or form a partnership

• Seek help or be granted help from any US person

• Do banking, obtain finance, credit cards, etc.

The amazing thing is that this all is happening in the United States of America, the land of democracy and due process; the exporter of democracy to the world, and it's happening:

• Without evidence (except for internet stories)

• Without indictment

• Without court or trial

• Without jury, and

• Without the right for legal representation!
