My name is Richard Ammar Chichakli. On 11/30/2005 the security council committee on Liberia included my name and several of my companies in the Travel Ban and Assets Freeze lists established pursuant to resolution 1521 (2003), and published on 01/12/2005 under no. SC/8570

The “Designation Justification” you provided in your above referenced document is entirely false, groundless, lacks any credible evidence, and it is based on unfounded allegations brought by the US government for political reason outside the US justice system on April 26, 2005. The US government is yet to substantiate its allegations or bring charges in a court of law.  

The UN was used by the US government as a tool to allow the Bush regime to execute a plan that CANNOT be executed under the laws of the United States. The UN acted blindly at the request of the American government, and used the material the UN FALSELY included in its report S/2000/1225 after it FAILED to abide by ITS OWN regulations as stated in paragraph-6 of the same report.

I provided herewith attachments that provide summary explanation to each and every point mentioned in your “justification for inclusion” and which I can support by credible and undisputable evidence, and the sworn statement of live witnesses.

Accordingly, I demand that my name and the names of all entities I controlled be immediately removed from your list and any other list or reference because what you published as justification is UNSUPPORTED LIES, which I challenge you to substantiate.

Answers to the accusations of US Treasury:

The following was listed as a justification of including Richard Chichakli in the list of persons subject to sanctions against Liberia:

“A Syrian-born US citizen who has been an employee/ associate of Viktor Bout for about a decade[1]. The UN identified Chichakli as Viktor Bout’s Chief Financial Manager[2] and, therefore, as one who acts at Bout’s direction. His own resume details his senior positions with several Bout-controlled companies[3]. A certified public accountant and certified fraud examiner with more than 12 years of experience, plays a significant role in assisting Bout in setting up and managing a number of his key firms[4] and moving money[5] (both for acquisition of assets and reparation of profits). In media interviews, reportedly has held himself out as spokesperson for Viktor Bout and his network[6]. Chichakli is an officer of San Air General Trading[7]. Payments for many of the weapons that went to Liberia through Victor Bout’s network in 2000 and 2001 were directed to San Air’s bank accounts[8]. As such, Chichakli is associated with an entity providing financial or military support to armed rebel groups in Liberia or in countries in the region[9].”

 

[1] This statement is a repetition of Johan Peleman’s false statement appeared in his report No. S/2000/1225 to the UN about Angola in (Exhibit-2). The fact is Chichakli was not an employee or associate of Bout for a decade or any length of time as illustrated in Exhibit-1

[2] This statement is also a verbatim repetition of the false report mentioned above. Chichakli never held any position in any of Victor Bout’s entities, and it was impossible for Chichakli to have had held such position to direct day-to-day activities from half way around the globe while serving in the United States Army, serving payroll and tax client, attending schools, or teaching classes in the community colleges in Texas. It is important to mention that Chichakli had never received salaries, compensation, or employment benefits from Victor Bout or his entities evidenced by the available bank and tax records.

[3] The resume the US Treasury referred to is fake resume that does not reflect the truth, nor it can be correct. The said resume states that the position was located in South Africa and during certain time in which Natalie Piret the counsel of Victor Bout testified in an official statement made to the Belgian Authority that Chichakli was not. During the same time Chichakli was an employee of the United States Department of Justice, INS Dallas Finance Center in Dallas, Texas, USA

[4]This is a false statement, Chichakli did not assist Bout in setting up nor managing “number of his key firms”

[5] This is a false statement. Chichakli never assisted Bout in moving any money for any purpose evidenced by the available bank records.

[6] This is a false statement. Chichakli never stated or held himself as spokesperson of Bout. Chichakli exercised his right to the freedom of speech and have stated his opinion regarding the accusation against Bout as a friend of Bout. Furthermore, Chichakli have always identified himself concerning Bout as a "friend and brother"

[7] Chichakli created San Air USA for Bout in the US and placed himself as an officer of San Air USA for the purpose of fulfilling state requirements. Chichakli WAS NOT an officer of San Air UAE to which account an alleged payment from the Liberian Maritime located in the USA was made.

[8] This is a false statement. No payment whatsoever from Liberia Liberian interest for weapons or anything else were directed to San Air USA

[9] False statement based on false assumptions and no supporting evidence.  The US treasury use the exact language stated in the UN resolution about Liberia to credit their action. Chichakli is not associated with any entity providing OR have provided military or financial support to Liberia or any other entity or country in the region or anywhere else in the world.

Exhibit – 2

This is an extract from the investigative report done by the panel on Angola and adopted by the UN under S/2000/1225 on 18 December 2000. This report invented relation between Victor Bout who was in South Africa and Richard Chichakli who was half-world away in the United States (Pages 1 and 36 of S/2000/1225 are attached as “Exhibit-3”).

In order to make his allegation about Victor Bout’s alleged network credible; as he drawn in paragraph -138 of the mentioned report; The report inserted the name of Richard Chichakli, a highly qualified financial advisor and a world’s renowned financial planner in the field of aviation, and associated Chichakli with Bout through an invented connection reported in paragraphs 139 and 140 of the same report under “Bout-Chichakli.”

The report claimed in the year 2000 that Chichakli was an associate of Bout for more than a decade was not aware that during the first half of the 90s Chichakli was a soldier of the United States Armed Forces, and then he was a full-time student, and a university professor in addition to his regular job which involved running and managing two public accounting offices in Texas, USA.

The UN panel NEVER contacted Richard Chichakli to verify the correctness of the allegedly relation as IT MUST HAVE DONE in compliance with paragraph-6 of the same report. The UN Security Council took what was reported as a fact, and that was the beginning of the Chichakli-Bout connection that evolved into the inclusion of Richard Chichakli in the sanctions against Liberia. Chichakli never had any relation or business with Liberia, nor was he a “financial manager” for Bout or any of his organizations.  Below is the text from the UN S/2000/1225 false report, and which was used by the US government as justification to involve Chichakli in the sanctions against those profited from Liberia under Charles Taylor:

 

E. Victor Bout’s organization 

138. For an organization to operate effectively, it requires an extensive network of contacts and specialists. The section below, although not exhaustive, demonstrates that Victor Bout has acquired such a capability.

Bout-Chichakli

139. Richard Ammar Chichakli, born in 1959, has been an employee/associate of Victor Bout.s for several years. He is a specialist and who has been placed in an ideal position. He is a certified public accountant and a certified fraud examiner with more than 12 years of experience, in addition to his military experience in aviation and air traffic control.  

140.   Over the last decade, Mr. Chichakli has held senior positions in companies owned by Victor Bout. The chart below illustrates these connections. As chief financial manager, his responsibilities include directing the accounting, financial and reporting activities, including public reporting, auditing and overall responsibility for the financial systems. Indeed this appears to be an important position. What is more, Mr. Chichakli also holds the position of commercial manager at the free zone in Sharjah, United Arab Emirates. There, he is responsible for much of the liaison and commercial site activity, again playing a key role, especially as virtually all of Victor Bout.s companies, regardless of where they are registered, operate out of the United Arab Emirates, and from Sharjah in particular.
